Terms of Service

These Terms of Service ("Terms") govern your access to and use of Travilead's travel lead management service (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Travilead provides a cloud-based software platform for travel agencies to manage leads, assign agents, track pipelines, and organize workflow. The Service includes features such as lead boards, agent management, routing rules, queues, and reporting tools.

3. Account Registration

3.1 Account Requirements

  • You must be at least 18 years old to use the Service
  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activities that occur under your account

3.2 Team Accounts

If you are invited to join a team, you agree to comply with your team administrator's policies and instructions. Team administrators have the authority to manage team members, access team data, and modify team settings.

4. Subscription and Payment

4.1 Subscription Plans

The Service is offered on a subscription basis with different plans (Starter, Team, Agency). Each plan includes specific features and agent limits. All plans include a 7-day free trial period.

4.2 Billing

  • Subscriptions are billed monthly in advance
  • Payment is processed through Stripe, our third-party payment processor
  • You are responsible for providing valid payment information
  • All fees are non-refundable except as required by law

4.3 Plan Changes

You may upgrade or downgrade your plan at any time. Plan changes take effect at the start of your next billing cycle. Prorated charges or credits may apply.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service until the end of your paid period.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Transmit any malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems to access the Service without permission
  • Share your account credentials with unauthorized parties
  • Upload content that infringes on intellectual property rights

6. User Content and Data

6.1 Your Content

You retain ownership of all data and content you upload to the Service ("User Content"). By using the Service, you grant us a license to use, store, and process your User Content solely to provide and improve the Service.

6.2 Data Protection

We implement security measures to protect your data. However, you are responsible for backing up your data and ensuring its accuracy.

6.3 Data Export

You may export your data at any time through the Service's export features. Upon account cancellation, we will retain your data for a reasonable period to allow for data recovery, after which it will be deleted.

7. Intellectual Property

The Service, including its software, design, text, graphics, and other content, is owned by Travilead and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Service Availability

We strive to provide reliable service but do not guarantee that the Service will be available 100% of the time. The Service may be unavailable due to maintenance, updates, or unforeseen circumstances. We are not liable for any damages resulting from Service unavailability.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVILEAD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Indemnification

You agree to indemnify and hold harmless Travilead, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another.

11. Termination

We may suspend or terminate your account and access to the Service immediately, without prior notice, if you violate these Terms. Upon termination, your right to use the Service will cease, and we may delete your account and data.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
